To operate our business, including creating, maintaining, and renewing membership and account profiles; to confirm your identity when you become a member; to maintain the member directory; to provide information about your membership, updates, order confirmations, security alerts, and support and administrative messages; to provide better and more personalized service; to better manage your relationship with us.
  • Business Operations, Legal and Security. To maintain billing, accounting and internal operations; to protect the security of our networks and systems; to help us improve our website; to enforce our policies; to detect and protect against fraudulent, illegal, harmful, or unauthorized activity; to manage risk.
  • Product and Service Delivery. To provide services and products; to process, fulfill, ship, and deliver your orders; to secure, troubleshoot, improve, and personalize products and services.

TRANSFERRING YOUR INFORMATION

CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

  • Newsletters and Marketing Communications from SMACNA. If you have opted in to receive certain marketing or promotional emails from us but no longer wish to have your email address or contact information used by SMACNA to promote our own or third parties’ products or services, you can opt out by visiting the “My Profile” page on our website. In addition, a link to manage your marketing preferences is included in the footer of every SMACNA marketing email. You can opt-out by following the instructions contained in those emails or by sending us an email to memberservices@smacna.org stating your request.

DATA SECURITY

We will take all reasonable steps to ensure the safety of your personal information. The website has industry-standard security measures in place to protect the loss, misuse, and alteration of the information under our control. We periodically review our information collection, storage and processing. Despite these reasonable measures, we cannot guarantee our security measures are impenetrable, and we cannot and do not promise or warrant that your information will always remain secure.

DATA RETENTION

Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.

CHILDREN’S PRIVACY

Our website is not directed to children under the age of thirteen (13). If you are not thirteen (13) years or older, do not use our website. We do not knowingly collect personal information from children under the age of thirteen (13). If we learn that personal information of persons younger than thirteen (13) years-of-age has been collected through our website, we will take the appropriate steps to delete this information. You may request access, updating and corrections of inaccuracies in the personal information we have in our custody or control, withdraw your consent to the collection, use or disclosure of your personal information or exercise any additional privacy rights available to you, by logging into your SMACNA.org account, by submitting a request to memberservices@smacna.org, or by contacting us through the means provided at the end of this Policy.

We may request certain specific information for the purposes of verifying the identity of the individual seeking access to their personal information records. Applicable law may allow or require us to refuse to provide you with access to some or all of the personal information that we hold about you, or we may have destroyed, erased, or made your personal information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

If you believe that applicable data protection laws have not been complied with, you may lodge a complaint with us by using the contact information provided below. You also have the right to complain directly to the appropriate data protection authority.

WITHDRAWING YOUR CONSENT

Where you have provided your consent to the collection, use, and transfer of your personal information, you may have the legal right to withdraw your consent under certain circumstances. LEGAL PROCESS AND INVESTIGATION ISSUES

From time to time, we may be required to respond to a subpoena or similar investigative demand from law enforcement, a court order, a government agency, or a private litigant. We reserve all rights to defend, within our sole discretion, against such legal requests, demands, and claims. For instance, we may raise or waive legal objections or rights. When changes are made to this Policy, we will revise the “Effective Date” shown at the bottom of this Policy. If we make any material changes in the way we collect, use, or share your personal information, we will also post notice of the changes on our website or may notify you by sending an e-mail. Your continued use of our website after we have posted any Policy changes indicates your agreement to the changes.
